Our Experts

Robert Anderson

Robert is the Managing Director of RDC and has over 30 years experience in debt recovery and dispute resolution work.    He has been working in this area since he qualified in 1984 and has acted for numerous commercial clients recovering millions of pounds of outstanding invoices for his clients.  Robert has considerable experience for many years as a Director and Supervisor in the dispute resolution.

Ram Saroop

Ram has worked in the Dispute Resolution Department of RDC Solicitors since 1992.  Initially he started with a varied case load of Civil and Criminal Cases and since 1996 has developed a speciality in Civil Cases.   Ram provides legal services primarily in Professional Negligence, Employment, Property Dilapidations, Boundary Disputes, Personal Injury Claims and Legal Costs.  He has successfully taken cases to the High Court and the Court of Appeal and is a Director and Supervisor in dispute resolution and employment, with many year's experience.

In 1998 Ram was appointed as a Conciliation Officer by the Law Society to assist with complaints and claims against solicitors. After ten years as a Conciliation Officer he was appointed as a Consultant advising solicitors regarding complaints and client care procedures.  Currently Ram assists a number of Charities and other organisations outside his professional work and is an authorised person to conduct Civil Marriages at his Community’s Bhawan.  He also completed a Master of Business Administration degree (MBA) in December 2023.

Ram was appointed Solicitor Costs Assessor in 2004, sitting in the High Court at the Royal Court of Justice on Cost Appeals.  He has also assisted the Senior Courts Costs Office in assessment of legal costs and appeals.

Ram is able to read and write Hindi and Punjabi and speaks Urdu fluently.  He has been a Member of the Law Society’s Personal Injury Panel and Association of Personal Injury Lawyers and is currently a Member of the Professional Negligence Lawyers Association and Association of Northern Mediators.

Occasionally one of our legal assistants may work on your matter.  All our legal assistants have experience of debt collection and are supervised by one of our Directors above.

Pricing

Our Pricing for Debt Collection

Costs are an important factor for a business that needs to collect an outstanding debt.  We are happy to discuss various options with you concerning our fees.

We can offer either a fixed fee, or one based on the work that we carry out to collect your debt.   If we base our fees on the latter, details of our hourly rates are set out at the bottom of this page.  Please get in touch so that we can discuss the matter with you and help you to decide which option will best suit your requirements.

We set out below a range of our example fixed fees for a business to business debt.  If you require information concerning recovery of an outstanding personal debt, please contact us to discuss our range of costs options.

Court Claims

These costs apply where your claim is in relation to an unpaid invoice, which is not disputed and enforcement action is not needed.   If the other party disputes your claim at any point, we will discuss any further work required and provide you with revised advice about costs if necessary, which could be on a fixed fee (e.g. if a one off letter is required), or an hourly rate if more extensive work is needed.

Where VAT is payable, this is at the current rate of 20%.

If you wish to proceed with a claim you should note that:

  • The VAT element of our fee cannot be reclaimed from your Debtor.
  • Interest and compensation may take the debt into a higher banding, with a higher cost.
  • The costs quoted above are not for matters where enforcement action, such as the Bailiff, is needed to collect your debt.

Our fee includes:

  • Taking your instructions and reviewing documentation.
  • Undertaking appropriate searches.
  • Sending a letter before action.
  • Receiving payment and sending onto you, or if the debt is not paid, drafting and issuing claim.
  • Where no Acknowledgement of Service or Defence is received, applying to the Court to enter Judgement in default.
  • When Judgement in default is received, write to the other side to request payment.
  • If payment is not received within X days, providing you with advice on next steps and likely costs.

We can agree fixed fees or contingency fees for straight forward matters for a one day hearing and an hourly charge rate (as set out below) for complex matters which are likely to be more than day’s hearing

Stages of the Process

Matters usually take 8 to 26 weeks from receipt of instructions from you, to receipt of payment from the other side, depending on whether or not it is necessary to issue a claim.   This is on the basis that the other side pays promptly on receipt of Judgement in default.   If enforcement action is needed, the matter will take longer to resolve.
